If you are experiencing acute medical distress, severe chest pain, sudden shortness of breath, severe allergic reactions, or thoughts of self-harm, immediately call your local emergency medical service (e.g., 102 / 112 in India, 911 in the US, or 999 in the UK) or proceed immediately to the nearest hospital emergency department. Do not rely on digital telemetry, companion messaging, or telehealth appointments for acute medical crises.

1. Acceptance of Terms & Scope of Agreement

By accessing the ELIKYANZA platform and commissioning our Sleep Optimization protocols, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and ELIKYANZA Executive Health Solutions regarding your use of our clinical methodologies, proprietary reset kits, and retainer services.

These Terms of Service, along with our Privacy Policy, govern your access to our active homeopathic protocols, diagnostic audit tools, digital companion tracking software, and clinical telehealth consultations.

2. Service Eligibility, Clinical Scope & Medical Disclaimer

ELIKYANZA services are exclusively intended for executive clients aged 25–65 in stable medical condition. Participants must fully disclose all major medical diagnoses, current pharmaceutical medications, and diagnosed sleep disorders during the initial audit phase. Our optimization programs are not suitable for individuals in acute psychiatric crisis, those with uncontrolled cardiovascular disease, during pregnancy, or with active substance dependence. ELIKYANZA reserves the absolute right to decline service initiation or discontinue active protocols if safety criteria are not maintained or baseline health status changes.

  • A. Complementary & Foundational Nature: ELIKYANZA provides active homeopathic care protocols, autonomic diagnostic mapping, and biomarker tracking. Our protocols are designed to support autonomic regulation, sleep architecture, and stress resilience. They are complementary wellness formulations and do not replace emergency medical care or primary clinical treatment.

  • B. Telehealth & Distance Limitations: Digital consultations provided through ELIKYANZA adhere to applicable Telemedicine Practice Guidelines. Telehealth evaluations are based on patient-reported intake data, wearable telemetry (HRV, sleep stages), and diagnostic lab panels. Distance consulting has inherent physical examination limitations. You acknowledge that practitioners rely on the accuracy and completeness of the health history you provide.

  • C. Individual Response Variability: Human physiology varies dynamically based on baseline health, genetics, lifestyle compliance, travel, and environmental stressors. ELIKYANZA makes no explicit guarantee or warranty of specific health outcomes or cure timelines.

3. Program Protocols, Commercial Terms & Taxation (GST)

A. Service Tier Offerings

 

ELIKYANZA provides two primary clinical performance pathways:

  • The 90-Day Sleep Reset Kit: A foundational 90-day active homeopathic protocol including baseline diagnostic evaluation and digital companion telemetry access.

 

  • The Executive Concierge Membership: A fully supervised, quarterly private retainer featuring active physician auditing, quarterly diagnostic panels, and real-time protocol adjustments.

B. Dynamic Pricing & Statutory Tax (GST)

 

All program fees, retainer rates, and custom intervention costs are dynamically displayed at the point of purchase on our official Service Page and Checkout Portal.

  • All listed fees are strictly subject to applicable statutory taxes, including 18% Indian Goods and Services Tax (GST).

  • Fees are billed in Indian Rupees (INR) unless explicitly stated otherwise via international invoice.

  • ELIKYANZA reserves the right to modify program pricing, retainer fees, or service scope at any time. Any fee updates will not impact active contracts already in effect.

4. Corporate Billing, Refund & Cancellation Policy

A. Corporate Invoicing & GSTIN Compliance

B2B tax invoices incorporating the client's corporate GSTIN will be automatically generated upon payment confirmation. Clients requiring corporate tax credits must provide valid corporate details prior to transaction processing.

B. Refund Policy & Pre-Formulation Window

​

Due to the bespoke, customized nature of active homeopathic micro-potency formulations and immediate digital telemetry allocation:

​

  • Standard Refund Window: Cancellation requests submitted in writing to operations@elikyanza.com within 24 hours of order placement (and prior to physical kit dispatch or diagnostic intake initiation) are eligible for a full refund minus a 3% administrative transaction fee.

​​

  • Non-Refundable Phase: Once the physical Reset Kit has been dispatched or the initial 30-minute clinical consultation has been completed, all intervention fees become 100% non-refundable.

 

C. Executive Concierge Membership Cancellations

​

Executive Concierge retainers operate on a quarterly commitment cycle. Written cancellation notice must be received at least 14 business days prior to the next quarterly billing cycle to prevent auto-renewal.

5. Autonomic Calibration & Client Responsibilities

The ELIKYANZA operational framework requires strict adherence to calibration timelines. Failure to comply with prescribed biomarker data uploads may result in suboptimal protocol adjustments.

To maintain clinical integrity, you agree to:

  • Provide truthful, complete, and updated medical history during intake evaluations.

​

  • Continue any pre-existing, prescribed essential medical therapies unless advised or adjusted by your primary treating physician.

​

  • Keep wearable tracking devices reasonably charged and synced to ensure accurate telemetry calibration.

6. Intellectual Property & Digital Rights

All protocol materials, diagnostic frameworks, digital tracking software interfaces, logos, brand copy, and clinical educational assets on elikyanza.com are the exclusive intellectual property of ELIKYANZA Executive Health Solutions. Client access grants a personal, non-exclusive, non-transferable license for individual health optimization use only. Unauthorized reproduction, resale, or reverse engineering is strictly prohibited.

7. Clinical Data Privacy

Your diagnostic data and wearable telemetry metrics are encrypted using institutional-grade 256-bit SSL protocols in accordance with applicable HIPAA and DPDPA data governance standards. Clinical practitioners access your baseline results only to ensure safe and effective recalibration cycles.

8. Limitation of Liability

ELIKYANZA is not liable for outcomes resulting from undisclosed clinical conditions or concurrent use of pharmaceutical sedatives not reported during the initial diagnostic intake.

To the maximum extent permitted by applicable law, ELIKYANZA, its directors, clinical practitioners, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages resulting from platform use, telemetry delay, or failure to follow prescribed clinical instructions. Total aggregate liability shall not exceed the amount paid by the client for the specific protocol or service within the preceding 6-month period.

9. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or ELIKYANZA services shall be subject to the exclusive jurisdiction of the competent courts in Maharashtra, India.
